Audrey Leather Goods is an independent Hungarian leathercraft brand creating handcrafted leather goods in small batches using traditional craftsmanship techniques and carefully selected materials. Each product is made with particular attention to quality, durability and timeless design.

  1. SCOPE OF THESE TERMS

These Terms and Conditions apply to all purchases of products offered through the Audrey Leather Goods online store available at:

www.audreyleathergoods.hu

These Terms govern all legal relationships established between Audrey Leather Goods (“Seller”) and any customer (“Customer”) placing an order through the Website.

By accessing the Website and placing an order, the Customer confirms that they have read, understood, and accepted these Terms and Conditions.

The Seller reserves the right to amend these Terms at any time.

Any amendments become effective upon publication on the Website and shall not affect contracts concluded prior to the publication date.

  1. APPLICABLE LEGISLATION

These Terms and Conditions are governed by and interpreted in accordance with the laws of Hungary and applicable European Union legislation, including but not limited to:

  • Act V of 2013 on the Hungarian Civil Code;
  • Act CLV of 1997 on Consumer Protection;
  • Act CVIII of 2001 on Electronic Commerce Services;
  • Government Decree 45/2014 (II.26.) on contracts between consumers and businesses;
  • Government Decree 19/2014 (IV.29.) NGM on complaint handling and warranty claims;
  • Government Decree 151/2003 (IX.22.) on mandatory warranties for consumer goods;
  • Government Decree 373/2021 (VI.30.) on price indication requirements;
  • Regulation (EU) 2016/679 of the European Parliament and of the Council (General Data Protection Regulation – GDPR);
  • Applicable consumer protection directives and regulations of the European Union.

For customers located outside the European Union, mandatory consumer protection provisions of the customer’s country of residence may also apply where required by law.

  1. DEFINITIONS

For the purposes of these Terms:

Seller Adrienn Tálosi Sole Proprietor, trading under the brand name Audrey Leather Goods.

Customer Any natural person or legal entity purchasing products through the Website.

Consumer A natural person acting for purposes outside their trade, business, craft, or profession.

Product Any handmade leather product offered for sale through the Website, including but not limited to:

  • bags,
  • wallets,
  • card holders,
  • belts,
  • leather journals,
  • notebook covers,
  • organisers,
  • phone cases,
  • accessories,
  • and other leather goods.

Contract The legally binding sales agreement concluded between the Seller and the Customer through the Website.

Distance Contract A contract concluded without the simultaneous physical presence of the parties, exclusively through means of distance communication.

  1. LANGUAGE AND FORMATION OF THE CONTRACT

The Website may be available in multiple languages.

The legally binding version of these Terms is the English version unless otherwise expressly stated.

Orders placed through the Website constitute electronic contracts.

The contract is not considered a written agreement and is not filed by the Seller.

Contract Formation Process

The products displayed on the Website do not constitute a legally binding offer by the Seller.

The Customer submits a binding offer to purchase by completing the checkout process and clicking the button indicating an obligation to pay.

After submission of the order, the Customer receives an automatic confirmation email acknowledging receipt of the order.

This automatic acknowledgement does not constitute acceptance of the Customer’s offer.

The sales contract is concluded only when the Seller expressly confirms the order and makes such confirmation available to the Customer via email.

If the Customer does not receive the automatic acknowledgement email within 48 hours of submitting the order, the Customer shall no longer be bound by the offer.

The Seller reserves the right to reject any order in whole or in part, particularly in cases involving:

  • incorrect product information,
  • pricing errors,
  • stock shortages,
  • suspected fraud,
  • or circumstances beyond the Seller’s reasonable control.

In such cases, any payments already received shall be refunded promptly.

  1. PRODUCTS

Audrey Leather Goods designs and manufactures handcrafted leather goods using traditional craftsmanship techniques and carefully selected materials.

Products available through the Website may include, but are not limited to:

  • handbags;
  • shoulder bags;
  • wallets;
  • card holders;
  • belts;
  • leather organisers;
  • notebook covers;
  • journal covers;
  • phone cases;
  • key holders;
  • leather accessories;
  • other handcrafted leather products.

Products may be offered either:

  • as ready-made items available from stock; or
  • as made-to-order items produced after the order has been placed.

Product Information

The Seller makes every reasonable effort to ensure that product descriptions, specifications, dimensions, colours and photographs accurately represent the products offered for sale.

However, due to:

  • differences in screen settings and device displays;
  • lighting conditions during photography;
  • the handmade nature of production;
  • the characteristics of natural materials;

the actual appearance of a product may vary slightly from the images displayed on the Website.

Such variations shall not be considered defects.

Natural Characteristics of Leather

Many Audrey Leather Goods products are made from genuine leather, including vegetable-tanned leather.

Natural leather may contain:

  • minor surface marks;
  • natural wrinkles;
  • grain variations;
  • colour differences;
  • healed scars;
  • texture irregularities.

Over time, leather may also develop a natural patina and changes in colour depth resulting from use and exposure to environmental conditions.

These characteristics are inherent features of genuine leather and shall not be regarded as defects, faults, or grounds for warranty claims.

  1. ORDERING PROCESS

Products may be purchased through the Website without creating a customer account unless otherwise specified.

Placing an Order

To place an order, the Customer must:

  1. Select the desired product(s);
  2. Add the product(s) to the shopping cart;
  3. Proceed to checkout;
  4. Provide the required billing and delivery information;
  5. Select a payment method;
  6. Review the order details;
  7. Confirm acceptance of these Terms and Conditions;
  8. Submit the order by clicking the payment obligation button.

Before final submission, the Customer has the opportunity to review, modify and correct any information entered.

The Customer is responsible for ensuring that all information provided is accurate and complete.

The Seller shall not be liable for delays, failed deliveries, additional costs, or other consequences arising from inaccurate or incomplete information supplied by the Customer.

  1. PAYMENT METHODS

The following payment methods are available through the Website.

8.1 Online Card Payment (Barion)

Secure online card payments are processed through Barion Payment Zrt.

The Seller does not receive, store, or process the Customer’s card details.

8.2 Bank Transfer (Wise)

Customers may pay by bank transfer using the following account:

Any bank transfer fees charged by the Customer’s financial institution shall be borne by the Customer.

The order may not be processed until the payment has been received and cleared.

8.3 Cash on Delivery (COD)

Where available, Customers may choose Cash on Delivery.

Additional COD fees may apply depending on the destination country and carrier policies.

Any such fees will be displayed during checkout before the order is finalized.

  1. SHIPPING AND DELIVERY

Shipping Destinations

The Seller currently ships to:

  • Hungary;
  • Member States of the European Union;
  • The United States of America;
  • Other countries where shipping services are available.

The Seller reserves the right to modify the list of shipping destinations at any time.

Shipping Provider

Orders are shipped primarily through Packeta (Zásilkovna) and its international logistics partners.

The available delivery options depend on the destination country and will be displayed during checkout.

Shipping Costs

Shipping charges are calculated based on:

  • destination country;
  • parcel size and weight;
  • selected delivery method.

The applicable shipping fee will be clearly displayed before the Customer submits the order.

Delivery Times

Estimated delivery times are provided for information purposes only.

Typical delivery periods are:

  • Hungary: 2–5 business days;
  • European Union: 3–10 business days;
  • United States: 7–20 business days.

Delivery times may vary due to customs procedures, carrier delays, public holidays, weather conditions, or other circumstances beyond the Seller’s control.

The Seller shall not be liable for delays caused by third-party carriers or customs authorities.

Customs Duties and Import Taxes

For deliveries outside the European Union, the Customer is solely responsible for:

  • customs duties;
  • import taxes;
  • VAT or sales taxes;
  • customs clearance charges;
  • any other governmental fees.

The Seller has no control over such charges and cannot predict their amount.

  1. RIGHT OF WITHDRAWAL

This section applies exclusively to Consumers within the meaning of applicable consumer protection legislation.

Withdrawal Period

Consumers have the right to withdraw from the purchase contract without providing any reason within fourteen (14) days.

The withdrawal period expires:

  • 14 days after the day on which the Consumer acquires physical possession of the Product; or
  • in the case of multiple products delivered separately, 14 days after receipt of the final product.

Exercising the Right of Withdrawal

To exercise the right of withdrawal, the Consumer must send a clear statement of their decision to withdraw from the contract.

The withdrawal deadline shall be deemed met if the notification is sent before the expiry of the 14-day period.

Effects of Withdrawal

If the Consumer withdraws from the contract, the Seller shall reimburse all payments received from the Consumer, including standard delivery costs, without undue delay and no later than fourteen (14) days after receiving the withdrawal notice.

The Seller may withhold reimbursement until:

  • the returned Product has been received; or
  • the Consumer provides evidence that the Product has been returned,

whichever occurs first.

The refund shall be made using the same payment method used by the Consumer unless otherwise agreed.

Return Shipping Costs

The direct cost of returning the Product shall be borne by the Consumer.

The Consumer is liable only for any diminished value resulting from handling the Product beyond what is necessary to establish its nature, characteristics and functioning.

  1. EXCEPTIONS TO THE RIGHT OF WITHDRAWAL

Pursuant to Article 16(c) of Directive 2011/83/EU on Consumer Rights and applicable Hungarian legislation, the Consumer’s right of withdrawal does not apply to certain products.

The Consumer may not exercise the right of withdrawal in relation to:

  • products manufactured according to the Consumer’s specifications;
  • products clearly personalized for the Consumer;
  • products bearing monograms, initials, names or custom inscriptions;
  • products modified according to the Consumer’s specific requests;
  • bespoke or custom-made leather goods produced following individual requirements.

The fact that a product is handmade or produced after an order is placed does not automatically make it a personalized product.

Standard products made according to the Seller’s regular product specifications remain subject to the Consumer’s statutory withdrawal rights.

  1. STATUTORY WARRANTY AND LEGAL GUARANTEES

The Seller is liable for defects in accordance with applicable Hungarian and European Union consumer protection legislation.

Nothing in these Terms shall limit or exclude any statutory rights that Consumers may have under applicable law.

12.1 Conformity of Goods

The Seller is responsible for ensuring that Products conform to the contract at the time of delivery.

Products shall be considered conforming if they:

  • correspond to the description provided on the Website;
  • possess the qualities and characteristics reasonably expected from such products;
  • are fit for their ordinary purpose;
  • are delivered in the agreed quantity and quality.

12.2 Consumer Remedies

In the event of a defect existing at the time of delivery, the Consumer may be entitled to request:

  • repair of the Product;
  • replacement of the Product;
  • an appropriate price reduction; or
  • termination of the contract and refund, where permitted by law.

The chosen remedy may be refused if impossible or if it would impose disproportionate costs on the Seller compared to an alternative remedy.

12.3 Warranty Period

Where mandatory statutory warranty rights apply, Consumers may enforce their claims within the periods established by applicable Hungarian and European Union legislation.

For Consumers, statutory warranty claims generally remain enforceable for a period of two (2) years from delivery of the Product, unless otherwise required by law.

12.4 Burden of Proof

Where applicable law provides for a presumption of non-conformity, any defect appearing within the legally prescribed period after delivery shall be presumed to have existed at the time of delivery unless proven otherwise.

After the expiry of the statutory presumption period, the burden of proof may shift to the Consumer in accordance with applicable legislation.

  1. NATURAL MATERIALS DISCLAIMER

Audrey Leather Goods products are handmade using genuine leather and other natural materials.

Due to the nature of these materials, products may exhibit:

  • natural grain variations;
  • colour differences;
  • wrinkles;
  • scars;
  • marks;
  • texture variations;
  • changes in appearance caused by use and ageing.

Vegetable-tanned leather in particular develops a unique patina over time and reacts to sunlight, moisture, oils and everyday use.

These characteristics are natural and desirable properties of genuine leather and do not constitute defects.

Normal wear and tear resulting from ordinary use shall likewise not be considered a defect and shall not give rise to warranty or compensation claims.

  1. COMPLAINT HANDLING

Customers may submit complaints regarding Products or the Seller’s activities using the following contact details:

The Seller shall investigate complaints and respond within a reasonable period and, where required by law, no later than thirty (30) days after receipt of the complaint.

The Seller shall maintain records of complaints in accordance with applicable legal requirements.

  1. ALTERNATIVE DISPUTE RESOLUTION

If a dispute between the Customer and the Seller cannot be resolved amicably, the Consumer may seek assistance through alternative dispute resolution procedures.

Consumers residing within the European Union may use the European Commission’s Online Dispute Resolution platform:

Consumers may also contact the competent Hungarian Conciliation Board (Békéltető Testület).

The Seller shall cooperate with legally applicable conciliation procedures as required by Hungarian law.

  1. DATA PROTECTION

The Seller processes personal data in accordance with:

  • Regulation (EU) 2016/679 (GDPR);
  • applicable Hungarian data protection legislation;
  • other relevant privacy regulations.

Detailed information regarding the processing of personal data is provided in the separate Privacy Policy available on the Website.

The Privacy Policy forms an integral part of the contractual relationship between the Seller and the Customer.

  1. INTELLECTUAL PROPERTY RIGHTS

All content displayed on the Website is protected by copyright, trademark and other intellectual property laws.

This includes, without limitation:

  • texts;
  • photographs;
  • graphics;
  • product descriptions;
  • designs;
  • logos;
  • branding elements;
  • website layout and visual appearance.

Unless otherwise indicated, all intellectual property rights belong to Audrey Leather Goods or are used under valid licence.

No content may be copied, reproduced, distributed, published, modified, transmitted or otherwise used without the Seller’s prior written consent.

  1. PRICE REDUCTIONS

Where the Seller advertises a price reduction, the previously displayed reference price shall be determined in accordance with applicable Hungarian and European Union legislation.

Unless otherwise required by law, the reference price shall be the lowest price applied to the relevant Product during the thirty (30) days preceding the introduction of the discount.

  1. FORCE MAJEURE

The Seller shall not be liable for any delay or failure to perform contractual obligations resulting from events beyond its reasonable control.

Such events may include, but are not limited to:

  • natural disasters;
  • floods;
  • fires;
  • epidemics or pandemics;
  • war;
  • armed conflict;
  • terrorism;
  • strikes;
  • transportation disruptions;
  • customs delays;
  • governmental actions;
  • internet or telecommunications failures;
  • severe technical failures.

The Seller shall inform affected Customers as soon as reasonably practicable.

  1. GOVERNING LAW AND JURISDICTION

These Terms and Conditions and any contracts concluded through the Website shall be governed by the laws of Hungary.

Nothing in these Terms shall deprive Consumers of the protection afforded by mandatory consumer protection laws applicable in their country of residence.

Any dispute arising from these Terms shall be subject to the jurisdiction of the competent Hungarian courts unless mandatory consumer protection legislation provides otherwise.

  1. FINAL PROVISIONS

If any provision of these Terms is found to be invalid, illegal or unenforceable, the remaining provisions shall remain in full force and effect.

The failure of the Seller to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

These Terms and Conditions apply to all legal relationships established through the Website.

The Seller reserves the right to amend these Terms at any time.

Any amendments become effective upon publication on the Website and shall not affect contracts concluded prior to their publication.

  1. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, the Seller shall not be liable for any indirect, incidental, consequential, special, exemplary or punitive damages arising out of or relating to:

  • the use of the Website;
  • the inability to use the Website;
  • delays in delivery caused by third parties;
  • interruptions of online services;
  • loss of profits;
  • loss of business opportunities;
  • loss of data;
  • business interruption.

Nothing in these Terms shall exclude or limit liability for:

  • death or personal injury caused by negligence;
  • fraud or fraudulent misrepresentation;
  • any liability that cannot be excluded or limited under applicable law.

The Seller’s total liability arising from any purchase shall in no event exceed the amount paid by the Customer for the relevant Product.

The Seller shall not be responsible for damages resulting from:

  • improper use of the Product;
  • failure to follow care instructions;
  • normal wear and tear;
  • modifications, repairs or alterations carried out by third parties;
  • improper storage or handling of the Product after delivery.
  1. RETENTION OF TITLE

All Products remain the exclusive property of the Seller until full payment of the purchase price and any applicable charges has been received.

Ownership of the Product shall pass to the Customer only upon receipt of full payment by the Seller.

The risk of loss or damage to the Product passes to the Customer upon delivery of the Product to the Customer or to a person designated by the Customer.

Where applicable law permits, the Seller reserves the right to reclaim Products for which full payment has not been received.

  1. ELECTRONIC COMMUNICATIONS

By using the Website and placing an order, the Customer agrees to communicate with the Seller electronically.

The Customer agrees that:

  • contracts may be concluded electronically;
  • legal notices may be delivered electronically;
  • order confirmations and contractual information may be provided by email;
  • electronic communications satisfy any legal requirement that such communications be in writing.

The Customer is responsible for providing a valid and functioning email address and for monitoring incoming communications, including spam or junk mail folders.

  1. ENTIRE AGREEMENT

These Terms and Conditions, together with the Privacy Policy and any documents expressly incorporated by reference, constitute the entire agreement between the Seller and the Customer concerning purchases made through the Website.

They supersede all previous agreements, understandings, negotiations and communications relating to the same subject matter.

No verbal statement or representation shall modify these Terms unless confirmed in writing by the Seller.
